Privacy policy

Your privacy matters to ELMOIRÊ. Personal information is collected only where reasonably necessary to respond to you, provide creative services, administer purchases, operate this website, meet legal obligations, and protect the practice and its clients.

Depending on how you interact with ELMOIRÊ, information collected may include your name, email address, telephone number where provided, business or billing information, project details, correspondence, order and transaction information, and any other information you choose to provide through inquiries, commissions, consultations, forms, purchases, or email correspondence.

Certain technical information may also be processed when you visit the website, such as IP address, browser or device information, security information, and cookie-related information where applicable.

How your information is used

Your information may be used to respond to inquiries; prepare proposals; provide branding, web design, creative direction and commissioned services; manage projects and client communications; administer and support digital-product purchases; maintain business, accounting and tax records; protect against fraud or misuse; comply with legal obligations; and establish or defend legal rights.

Where marketing communications are offered, they will only be sent where an appropriate legal basis exists. Making an inquiry, engaging ELMOIRÊ for a service, or purchasing a product does not by itself subscribe you to promotional marketing.

Legal basis

ELMOIRÊ serves clients internationally. Where applicable, ELMOIRÊ aims to handle personal information in a manner consistent with recognized data-protection principles, including the EU General Data Protection Regulation (GDPR) and comparable privacy laws in other regions.

Where the General Data Protection Regulation (GDPR) applies, information is processed where necessary to take steps at your request before entering into a contract, perform an agreement with you, comply with a legal obligation, pursue legitimate interests in operating and protecting the practice, or where you have provided consent.

Where processing is based on consent, you may withdraw that consent at any time. Withdrawal does not affect processing that was lawful before consent was withdrawn.

Digital products & payments

Digital products are sold and delivered through Payhip. When you use the Payhip checkout, Payhip processes personal information necessary to operate its platform, administer the transaction and provide digital delivery in accordance with its own privacy practices.

Information connected with a purchase may include your name, email address, country or region, product purchased, transaction date, amount, currency, order status and other information required to administer the purchase.

Relevant order information may be available to ELMOIRÊ where necessary for customer support, order administration, business records, dispute resolution and legal compliance.

Payments are processed through the payment services available at checkout, currently including Stripe. ELMOIRÊ does not receive or store your complete payment card number or card security code.

Third-party services

ELMOIRÊ works with trusted third-party services where necessary to operate the website and business. These currently include Squarespace for website hosting and functionality, Cloudflare for domain and DNS management, Payhip for digital-product commerce and delivery, and Stripe for payment processing.

These providers may process personal information according to their respective roles, legal obligations and privacy policies. Where a provider determines the purposes and means of its own processing, it is responsible for that processing under applicable data-protection law.

ELMOIRÊ does not sell, rent or trade your personal information.

Cookies

This website may use cookies and similar technologies necessary for its operation, functionality and security. Where non-essential analytics or similar technologies require consent under applicable law, they will be used subject to the relevant consent requirements.

Data retention

Personal information is kept only for as long as reasonably necessary for the purpose for which it was collected and to meet applicable business, accounting, tax and legal obligations.

Some information may therefore need to be retained even after a project, customer relationship or purchase has ended. A request for deletion does not require the deletion of information that ELMOIRÊ is legally required or otherwise lawfully entitled to retain.

Your rights

Where the GDPR applies, you may have the right to request access to your personal information, correct inaccurate information, request deletion where applicable, restrict certain processing, receive certain information in a portable format, object to certain processing, and withdraw consent where processing relies on consent.

You also have the right to lodge a complaint with the competent data protection supervisory authority. In Portugal, this is the Comissão Nacional de Proteção de Dados (CNPD).

Terms of service

Creative services provided by ELMOIRÊ may include brand identity, web design, creative direction, commissioned work and related creative services. The specific scope, deliverables, fees, payment schedule, timeline and usage rights for a project will be set out in the relevant proposal, agreement or other written project terms.

Where a project requires a deposit or initial payment to reserve availability or begin work, the amount and applicable conditions will be communicated before the project begins.

Project timelines depend on timely communication, feedback, approvals, materials and other information required from the client. ELMOIRÊ may reasonably pause or reschedule work where required information, feedback or payment is materially delayed.

Final deliverables may be withheld until amounts due under the relevant agreement have been paid, subject to applicable law and the terms agreed for the project.

Digital products & refunds

Digital products are supplied electronically through Payhip. Product descriptions, contents, formats and any applicable licence conditions are presented with the relevant product or at checkout.

Digital products are non-refundable and final once purchased. Because digital products are made available for immediate access or download, your right of withdrawal is waived once access or download has begun, in accordance with applicable consumer law. By completing a purchase, you acknowledge and expressly consent to immediate performance and to the resulting loss of your right of withdrawal, where required under applicable consumer protection law.

If you experience a technical problem accessing a digital product, receive an incorrect file, or believe a product is defective, please contact support@ateliercontour.design so the issue can be reviewed.

Cancellation, rescheduling, deposit and refund conditions for bespoke creative services are governed by the relevant project agreement and applicable law.

Copyright & intellectual property

Unless otherwise stated or agreed in writing, the content of this website and ELMOIRÊ's original creative work, concepts, designs, graphics, written materials, digital products, templates and other creative assets are protected by applicable intellectual-property rights.

For commissioned creative services, ownership and usage rights are governed by the relevant project agreement. Where rights are granted or transferred following completion and payment, only the rights expressly agreed for that project are granted or transferred.

Digital products are licensed according to the terms accompanying the relevant product. They may not be reproduced, resold, redistributed, sublicensed or made available to others except where expressly permitted by the applicable licence or by law.

ELMOIRÊ may display commissioned work in its portfolio, website, social media and promotional materials where this has been agreed with the client or is otherwise permitted under the applicable project terms.

AI usage

ELMOIRÊ may use artificial-intelligence-assisted tools as part of supporting creative or administrative processes, such as research, exploration, ideation or workflow assistance.

Creative direction, judgement and final client-facing work remain subject to human review and direction. Confidential client information will not knowingly be submitted to third-party AI tools in a manner inconsistent with agreed confidentiality obligations or applicable data-protection requirements.

Changes

These policies may be updated where ELMOIRÊ's services, products, providers, business practices or legal obligations change. The latest version will be published on this page together with its most recent update date.
